Penn State Scandal: Lawyer Claims PSU Officials Are Exempt From Abuse Reporting Law

If the allegations against the Penn State administration officials charged with perjury and failure to report abuse didn’t have you angry enough, just wait until you hear what their lawyer has to say. The charges allege that University officials Gary Schultz and Tim Curley were given an eyewitness report of Jerry Sandusky sexually assaulting a young boy in the team’s shower facilities and failed to relay that report to police.

Thomas J. Farrell, the lawyer for PSU senior vice president for finance and business Gary Schultz says that his client is exempt from laws mandating that he report sexual abuse of children because he did not come into direct contract with the kids in question.

Farrell told The Associated Press on Sunday that the mandated reporting rules only apply to people who come into direct contact with children. He also said the statute of limitations for the summary offense with which Schultz is charged is two years, so it expired in 2004.

That defense may get the officials off as far as the criminal charges, but their reputations and their jobs would likely be forever lost.
